1.1 Unsubby: The service provider that helps the consumer cancel active contracts and subscriptions with third parties.

1.2 Consumer: The natural person using Unsubby's services for non-commercial purposes.

1.3 Cancellation: The termination of subscriptions and contracts by the consumer with third parties, using Unsubby’s services.

1.4 Provider: The third party—such as a newspaper, magazine, energy supplier, insurance company, or charity—with whom the consumer has an active subscription or contract they wish to cancel.

1.5 Services: The tools and assistance provided by Unsubby to help consumers cancel subscriptions and contracts.

1.6 User: The consumer using Unsubby’s services.

ARTICLE 3 – APPLICABILITY

3.1 These Terms and Conditions apply to all agreements between Unsubby and the consumer regarding the use of Unsubby’s services.
3.2 By using Unsubby’s services, the consumer agrees to these Terms and Conditions.

ARTICLE 4 – THE OFFER

4.1 Unsubby offers consumers the ability to cancel active contracts and subscriptions with third parties.
4.2 The offer includes providing the provider’s relevant address details and ready-made cancellation letters.
4.3 Offers may have limited validity or be subject to conditions, which will be clearly stated.
4.4 The offer includes a clear and truthful description of the services offered, including product descriptions where applicable.
4.5 The consumer is responsible for reviewing the offer and understanding the rights and obligations that come with accepting it.

ARTICLE 5 – CONCLUSION OF AGREEMENT

5.1 An agreement between Unsubby and the consumer is formed when the consumer uses Unsubby’s services, such as requesting address details or printing and sending cancellation letters.
5.2 By using Unsubby’s services, the consumer agrees to any resulting payment obligations.
5.3 Unsubby reserves the right to refuse or terminate the agreement in cases of abuse, fraud, or violation of these Terms and Conditions.

ARTICLE 6 – USE OF SERVICES

6.1 The consumer is responsible for providing accurate and complete information required to use Unsubby’s services.
6.2 Unsubby does not guarantee the successful cancellation of subscriptions or contracts with the provider. The responsibility for correct cancellation lies with the consumer.
6.3 The consumer is responsible for timely and proper sending of the cancellation letter and following any instructions provided by Unsubby.
6.4 Unsubby reserves the right to modify, adjust, or discontinue services at any time without prior notice.

ARTICLE 7 – RIGHT OF WITHDRAWAL

7.1 Users have the right to withdraw their cancellation request within fourteen (14) days after submission. To exercise this right, the user must send an email to [email protected] and state the withdrawal request. Providing a reason is optional but may help expedite the request.
7.2 Unsubby will attempt to reverse the cancellation, provided the letter has not yet been sent. If successful, the user will be informed. If the letter has already been sent, the user will be advised to contact the provider directly. In such cases, the user is responsible for further communication.
7.3 The user is responsible for exercising the right of withdrawal within the given timeframe and understands that Unsubby initiates the process quickly upon receipt of a cancellation request. The user bears the risk and burden of proof for timely and correct exercise of this right.
7.4 If the withdrawal is successful, Unsubby will refund any service fees paid as quickly as possible to the user's original payment account.

ARTICLE 8 – OBLIGATIONS

8.1 If Unsubby offers electronic means for withdrawal, it will send an acknowledgment of receipt immediately after receiving the request.
8.2 Unsubby will refund all payments made by the consumer as quickly as possible, but no later than 14 days from the day the consumer notifies the withdrawal.
8.3 Unsubby will use the same payment method as the consumer used unless otherwise agreed. The refund is free of charge for the consumer.

ARTICLE 9 – REFUND POLICY

9.1 At Unsubby, customer satisfaction is a top priority. If you are not completely satisfied with our service, we offer a 100% money-back guarantee.
9.2 Refund requests must be submitted within thirty (30) days of purchase. To request a refund, email [email protected] with your order number and a brief explanation. Refunds are processed within five to seven (5–7) business days to the original payment method. If the original method is unavailable (e.g., expired card), an alternative method such as PayPal or bank transfer will be arranged.
9.3 Refunds are issued only to the original payment method used for the transaction to ensure a secure and verifiable process. If the method is no longer available, Unsubby may consider alternatives after proper verification.
9.4 If the cancellation letter has already been sent, Unsubby will still process the refund, but the cancellation cannot be reversed. To reactivate the subscription, the user must contact the provider directly.
9.5 Unsubby reserves the right to limit or deny refunds in cases of proven abuse or fraudulent use of the service.
9.6 This refund policy complies with all applicable consumer protection laws in regions where Unsubby operates, ensuring fair and transparent treatment of customers.

ARTICLE 10 – DELIVERY AND PERFORMANCE

10.1 Unsubby will exercise the utmost care when receiving requests and providing services.
10.2 The services requested are linked to the address provided by the consumer.
10.3 Unsubby will execute accepted requests as quickly as possible unless otherwise agreed with the consumer. If there is a delay, Unsubby will inform the consumer within two weeks of the request.
10.4 In the event of cancellation due to delay, Unsubby will refund the payment made by the consumer immediately.
10.5 Cancellation letters are sent via Pingen. In case of issues, the consumer should contact Unsubby to find an appropriate solution, including the possibility of resubmitting the request.
10.6 Execution times indicated on the website are estimates only and do not create any binding rights.

ARTICLE 11 – PAYMENT

11.1 Consumers are required to pay the current prices for Unsubby’s services unless otherwise agreed. The price for a one-time cancellation is 29,95 €, and the subscription price for My Unsubby is 5,95 € per month.

11.2 Payments must be made using the payment methods provided on Unsubby’s website.

11.3 Unsubby reserves the right to change the prices of its services. Price changes will be communicated to consumers and take effect after such notification.

11.4 By placing an order, you authorize us to use the provided payment method for future transactions related to additional or supplementary services you may choose to use. These services, including details and prices, will be clearly presented to you before any charges are made, allowing you to make an informed and conscious decision to accept or decline.

11.5 If you subscribe to My Unsubby, the subscription begins with a 7-day free trial. During this trial, you can use the full services of My Unsubby at no cost. If you wish to continue using the service after the trial, you will automatically be enrolled in the monthly subscription plan.

11.6 Your subscription will automatically renew at the end of each billing period unless you cancel it. A monthly fee of 5,95 € will be charged. We will inform you of any price changes and obtain your consent before making changes to the subscription terms.

11.7 You may cancel your My Unsubby subscription at any time via the "Subscription & Payment Methods" section under “My Account” on our platform or by email to [email protected]. If you cancel during the 7-day trial period, no charges will apply. If you cancel after the trial period, no refund will be issued for the current billing period, but no further charges will be made.

ARTICLE 12 – PRIVACY

12.1 Unsubby respects the consumer’s privacy and processes personal data in accordance with applicable legislation, as described in Unsubby’s privacy policy.

12.2 Unsubby will not share the consumer’s personal data with third parties without their consent, unless it is necessary to provide the services or required by law.

12.3 Consumers have the right to access, correct, or delete their personal data as outlined in Unsubby’s privacy policy.

ARTICLE 13 – LIABILITY

13.1 Unsubby is not liable for damages arising from the use of its services unless such damages result from injury to life, body, or health, or from a breach of essential contractual obligations (primary obligations), or other damages caused by intentional or grossly negligent misconduct by Unsubby, its legal representatives, or agents.

13.2 Unsubby is not liable for damages or delays caused by incorrect or incomplete information provided by the consumer.

13.3 Unsubby’s total liability is limited to the amount the consumer paid for Unsubby’s services.

13.4 The limitations mentioned above also apply to Unsubby’s legal representatives and agents, to the extent claims for damages are made against them.

13.5 The consumer shall indemnify Unsubby against any third-party claims arising from violations of rights or obligations by the consumer unless Unsubby is not responsible for the violation. This includes, in particular, claims related to content stored, published, and/or transmitted by the consumer using Unsubby’s services.

13.6 If Unsubby references third-party websites on its own website, Unsubby cannot be held liable for the content or existence of those external sites.

ARTICLE 14 – FORCE MAJEURE

14.1 In the event of force majeure, Unsubby is not obligated to fulfill its obligations.

14.2 Force majeure includes any circumstance beyond Unsubby’s control that prevents or hinders the fulfillment of its obligations, such as natural disasters, strikes, technical failures, or government measures.

14.3 In the case of force majeure, Unsubby will inform the consumer as soon as possible, and both parties will consult to find an appropriate solution.

ARTICLE 15 – CHANGES TO THE TERMS AND CONDITIONS

15.1 Unsubby reserves the right to amend or supplement these Terms and Conditions at any time.

15.2 Amended Terms and Conditions will take effect upon notification to the consumer. If the consumer does not agree with the changes, they have the right to terminate the agreement.

ARTICLE 16 – COMPLAINTS

16.1 Complaints about Unsubby’s services must be submitted as soon as possible, but no later than fourteen days after the issue arises. Complaints must be clear and complete and can be sent to [email protected].

16.2 Complaints submitted to Unsubby will be answered within 14 days of receipt. If a complaint requires a longer processing time, Unsubby will send an acknowledgment within 14 days with an indication of when a detailed response can be expected.

16.3 If a complaint cannot be resolved within a reasonable timeframe or within three months after submission, it becomes a dispute that may be subject to dispute resolution procedures.

ARTICLE 17 – FINAL PROVISIONS

17.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain fully effective.

17.2 These Terms and Conditions take effect on March 12, 2025, and replace all previous versions.

17.3 Unsubby is entitled to transfer its rights and obligations under this agreement to third parties.
